Extinggo — Terms & Conditions

1. Acceptance of these Terms

By creating an account, tapping “Proceed”/“Start ordering”, or placing an order on the Extinggo mobile application or website (the “Platform”), you confirm you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy, incorporated here by reference. If you do not agree, do not use the Platform.

3. Eligibility

You must be at least 18 years old and legally capable of contracting under the Indian Contract Act, 1872. The Platform is for use in India, only in areas we currently serve.

4. Your Account

4.1 Registration uses your mobile number and a one-time password (OTP). You are responsible for your device, account security, and all activity under your account. 4.2 You agree to provide accurate, current information (name, delivery address, precise location) and to keep it updated. Delivery and serviceability depend on it. 4.3 We may suspend, restrict (including disabling Cash on Delivery), or terminate an account for suspected fraud, abuse, repeated refusals/returns, or breach (Section 12).

5. Marketplace model, Products & BIS/ISI conformity

5.1 Extinggo is a technology platform and intermediary connecting you with vetted Sellers. The contract of sale is between you and the Seller, who is the seller of record and issues the GST tax invoice. Extinggo facilitates discovery, ordering, payment, delivery, and support. 5.2 Sellers are onboarded only after verification of GST registration and required documents. Products are represented to conform to the applicable Bureau of Indian Standards (BIS) specifications — e.g. IS 15683 for portable fire extinguishers — and to be ISI-marked where required. A Product’s specific standard, capacity, rating, and country-of-origin are shown on its page. 5.3 Fire extinguishers are pressurized, life-safety devices — not toys. You agree to read the manufacturer’s manual and safety markings, keep units away from children, and use them only for their intended purpose and rated fire class. 5.4 A fire extinguisher is a supplementary first-response device. It is NOT a substitute for a professionally designed fire-protection system, statutory fire compliance, trained personnel, or the fire brigade. You are responsible for your overall fire safety and any applicable fire-safety law for your premises.

6. Correct selection, installation & mounting (customer responsibility)

6.1 Different fires require different extinguishers (ABC dry powder, CO₂, water, foam, K-class). You are responsible for selecting the correct type, class, and capacity for your risk, or for consulting a qualified professional. Extinggo and the Seller do not warrant a Product is suitable for any particular premises or hazard beyond its stated rating. 6.2 Installation, mounting height, signage, and accessibility should follow IS 2190 and the National Building Code (NBC). Professional installation, where offered, is an optional, separate Service.

7. Servicing, refilling & warranty

7.1 Servicing is not warranty. The manufacturer’s warranty (typically 12 months, as stated on the product page) covers manufacturing defects only. 7.2 Fire extinguishers require periodic servicing/refilling to remain reliable, per IS 2190 / NBC and the manufacturer’s instructions (intervals vary by type). Arranging periodic servicing is your responsibility. Servicing reminders in the Platform are a convenience only and do not transfer that responsibility to us. 7.3 Servicing/refilling must be performed by a certified fire-safety agency. A unit that is expired, discharged, over-pressurised, tampered with, or not serviced as required may fail to operate, and Extinggo and the Seller are not responsible for such failure.

8. Orders, pricing & payment

8.1 Prices are in Indian Rupees; GST and delivery fees are shown at checkout before you pay. 8.2 Payment options are Cash on Delivery (COD) and online payment (UPI, cards, net-banking via our payment partner, Razorpay), where available. We do not store your full card/UPI credentials; online payments are handled by the payment partner. 8.3 We may limit or withdraw COD for certain accounts, orders, pincodes, or values (Section 12). An order is confirmed only when the Seller accepts it; we may decline or cancel for unavailability, pricing errors, un-serviceable location, or suspected fraud, and will refund any amount already paid.

9. Delivery

9.1 We deliver only within currently serviceable areas, determined by your device location. Estimated delivery windows are indicative, not guaranteed. 9.2 Delivery requires a valid delivery One-Time PIN. Share the delivery PIN only with the Delivery Partner at your doorstep — never over a phone call. Extinggo will never call you to ask for it. 9.3 Repeated failed deliveries, refusals, or an unreachable contact may lead to cancellation and restrictions (Section 12).

10. Cancellation, returns & refunds

10.1 Buy orders may be cancelled from the app until our delivery agent picks the order up from the seller; once picked up, the order can no longer be cancelled from the app. Refill orders may be cancelled free of charge any time before our agent collects your equipment; once collected, the delivery charge applies to any cancellation. 10.1A Each order receives one delivery attempt. At the doorstep you may refuse the order before paying (COD) or before sharing the delivery PIN, in which case the order is cancelled; if you are unavailable at delivery, the order is likewise cancelled. If you are not at home and ask us, on the delivery call, to leave the order at your doorstep, sharing your delivery PIN on that call constitutes your acknowledgement of delivery. 10.1B Repeated doorstep refusals or failed deliveries may, at Extinggo’s discretion, result in cash-on-delivery being withdrawn for your account, suspension of your account, or refusal of service. 10.2 No returns on used, discharged, activated, or tampered extinguishers — for safety, and because the contents are consumable. This does not affect your rights in respect of a defective or wrongly delivered Product. 10.3 A damaged, defective, expired, or wrong Product may be reported within 7 days of delivery via in-app support, with photographs. Approved cases are eligible for replacement or refund. 10.4 Approved refunds go to the original payment method; prepaid refunds to source (typically 5–7 business days, subject to the bank/payment partner). 10.5 Nothing here limits your rights as a consumer under the Consumer Protection Act, 2019.

11. Warranties & LIMITATION OF LIABILITY

11.1 Except for the manufacturer’s warranty and your non-excludable statutory rights, Products and Services are provided “as is”, and Extinggo disclaims implied warranties of merchantability or fitness for a particular fire risk beyond a Product’s stated rating. 11.2 To the maximum extent permitted by law, Extinggo’s and the Seller’s total aggregate liability arising out of or relating to a Product or order is limited to the amount you paid for that order. 11.3 To the maximum extent permitted by law, Extinggo and the Seller are NOT liable for any indirect, incidental, special, or consequential loss, or for loss of or damage to life or property arising from: (a) incorrect selection of type, class, or capacity; (b) improper installation, mounting, or storage; (c) failure to service, refill, inspect, or replace a unit as required; (d) use of an expired, discharged, or tampered unit; (e) misuse, or use beyond a Product’s rated capability; (f) any fire, or the failure of any fire to be controlled; or (g) any matter outside our reasonable control. A fire extinguisher may not extinguish every fire; your safety depends on correct selection, maintenance, and use, and on evacuating and calling emergency services when appropriate. 11.4 Nothing in these Terms excludes liability that cannot be excluded under Indian law (including for death or personal injury caused by proven negligence, or under the Consumer Protection Act, 2019).

12. Fair-use, anti-fraud & account restrictions

12.1 To protect Sellers, Delivery Partners, and other customers, we may, on reasonable grounds (e.g. repeated COD refusals/returns, payment fraud, chargebacks, abuse): (a) restrict Cash on Delivery and require online payment (softer — you can still order); or (b) block the account (hard — reserved for fraud/abuse). Restrictions are recorded with a reason. 12.2 You must not misuse the Platform, defraud, resell in breach of law, scrape or reverse-engineer the Platform, upload malware, or provide false information.

13. Ratings, reviews & user content

13.1 You may rate and review Products, Sellers, and deliveries only for orders you have received. Your content must be accurate, lawful, and not defamatory, obscene, misleading, or infringing. 13.2 By submitting content, you grant Extinggo a non-exclusive, royalty-free, worldwide licence to host, display, and use it in connection with the Platform. You are responsible for your content. 13.3 We may moderate, decline, or remove content that breaches these Terms or the law, and may adjust the affected rating accordingly. We are not obliged to publish any content.

14. Promotions, coupons & offers

Promotions, coupons, discounts, and referral offers are subject to their own specific terms, are time-limited, non-transferable, and have no cash value. We may add, modify, or withdraw them at any time, and may reverse benefits obtained through misuse or fraud.

15. Intellectual property

The Extinggo name, logo, Platform, and content are owned by or licensed to us. You may not copy, modify, distribute, or use them without our written permission.

16. Third-party links & services

The Platform may link to or rely on third-party sites and services (e.g. the payment partner, maps). We do not control and are not responsible for their content, practices, or availability; your use of them is governed by their terms.

17. Indemnification

You agree to indemnify and hold harmless Extinggo, its Sellers, Delivery Partners, and their personnel from any claim, loss, or expense (including legal fees) arising from your breach of these Terms, your misuse of the Platform or a Product, your content, or your violation of any law or third-party right.

18. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, fire, floods, epidemics, strikes, network or power failures, or acts of government.

20. Dispute resolution & arbitration

Subject to your non-excludable consumer-law rights, any dispute not resolved through grievance redressal shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996; the seat and venue shall be New Delhi, Delhi, and the proceedings in English.

21. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to Section 20 and applicable consumer-law protections, the courts at New Delhi, Delhi have jurisdiction.

22. General

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Platform. Notices to you may be given in the app or to your contact details on record.

23. Changes

We may update these Terms. Material changes will be notified in the app or by your contact details. Continued use after an update means you accept the revised Terms.
